Terms and Conditions

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://gitesdejavarzay.com website (the “Service”) operated by Gites de Javarzay (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

 

Property Terms and Conditions

  1. The rental property is known as Gîtes de Javarzay, 79110 Chef-Boutonne, France
  2. This is offered as a holiday rental subject to confirmation by gitesdejavarzay.com and Paul and Lorraine Kennedy to the renter (Guests).
  3. Smoking or vaping is not permitted inside the gîtes or around the swimming pool area.

Occupancy

Verbena Gîte has a maximum occupancy of 5 people

Mulberry Gîte has a maximum occupancy of 6 people.

  1. The maximum number of people per Gîte includes adults and /or children (babies will not be included in this number)
  2. The number and names of Guests must correspond to those submitted on the booking form
  3. Any changes must be agreed in advance with the Owner and must not exceed the maximum occupancy
  4. Day Guests must be agreed in advance with the Owners. If the maximum number of Guests is exceeded, the Owners reserve the right to terminate your booking with no refund
  5. The Lead Guest is responsible for all members of the Guest Party residing at and/or using the facilities of the Gîte. The Guest agrees to be considerate to those living in close proximity to the Gîte and neighbouring properties, to take good care of the Gîte and to leave it in the same condition as at the start of the rental period
  6. The Gîte is cleaned and checked prior to handover and the Guests are expected to clean prior to departure. The Owners also reserve the right to make retention from the Security Deposit, to cover additional cleaning cost if the Guests leave the Gîte in an unacceptable condition or damage is discovered
  7. Use of the Gîte and all amenities are entirely at the Guest’s own risk. Guest’s personal belongings (including motor vehicles) left in or around the Property are entirely at Guest’s own risk and no responsibility will be accepted by the Owners for any loss or damage thereto

Booking and Payment

  1. The Lead Guest must be 18 or over and is responsible for advising that all Guests in the party are aware of the terms and conditions and are adhered to
  2. Enquiries to reserve a Gîte can be made by the Lead Guest by email directly to the Owner and via booking websites. Once a reservation enquiry is confirmed as received by the Owner, the Lead Guest must complete and sign the booking form, acceptance of Terms and Conditions and return the same together with payment of the initial non-refundable deposit of 25% of the total rental due for the Guest’s stay in the Gîte in order to reserve the Gîte. The Owners will send a confirmation email/message to the Lead Guest confirming the reservation of the Gîte. This is the formal acceptance of the booking
  3. The booking is only guaranteed on receipt of the 25%deposit payment, signed booking form and acceptance of the Terms and Conditions . This deposit is non-refundable. This deposit should be paid within 24 hours of the booking being made
  4. The balance is due 8 weeks before your arrival date and a reminder will be sent
  5. Payments not received by the due date may result in the dates being released
  6. For bookings taking place within 8 weeks, the deposit and balance are payable at the time of booking
  7. We reserve the right to refuse a booking without giving a reason.

Cancellations

  1. An 8 week notice period is required for cancellation
  2. Cancellations made in excess of the 8 weeks will receive a full refund of the balance paid to date
  3. Bookings cancelled within 40-60 days of arrival will be refunded 50%of balance paid to date (or 100% if the dates are rebooked)
  4. Bookings cancelled within 30 days will not be refunded unless the Owners are able to rebook the dates
  5. Cancellations or changes to the booking resulting in a shortened stay made within 8 weeks before the arrival date, will forfeit the balance already paid. Every effort will be made to re-advertise dates cancelled/changed and if successful, the Owners will refund the balance in full
  6. In the unlikely event that the Owner should need to cancel your booking, your deposit and balance will be refunded in full. Every effort will be made to assist you to secure alternative accommodation
  7. The Owner will not be liable for any compensation requests should this happen
  8. Guests must not act in any way which may result in Gîtes insurance becoming void, voidable or cause an increase in premium. Permission to use the Gîte may be revoked with immediate effect by the Owners or notice given to the Guests to curtail the rental period if a Guest/Guests are in serious breach of the terms of this agreement
  9. The Owners shall not be liable to the Client for any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery appliance in the property, garden or swimming pool. Any loss, damage, injury or death that is the result of adverse weather conditions, fire, riot, strikes, war or other matters that are beyond the control of the Owners
  10. The Owners shall not be liable to the Guests
  11. Keys and electronic gate fobs must be returned to the us at your departure. A failure to do this will result in a charge of £20/25€ per key and £75£/100€ for the electronic fob
  12. The Gîte will be inspected on your departure and you may be charged for any damage, breakages or loss incurred. It is advisable therefore, to notify the Owners of any breakages which may occur during your stay so that the Owners can take appropriate action
  13. Please treat the facilities and accommodation with due care so that other Guests may continue to enjoy them
  14. Complaints or issues raised after departure will not be considered.
  15. We strongly advise that you take out comprehensive travel insurance to cover eventualities such as cancellation.

Check-In/Out

Check-in time on arrival day is from 15:00 (GMT +1) Check-out time on departure day is 11:00 (GMT +1)

Alterations to arrival and check-out times are by prior arrangement only with the Lead Guest and Owners.

Utilities

  1. The gîte is supplied with water, electricity and a WIFI connection. Any disruption to these services is out of the control of the Owner. Every effort will be made to restore these services ASAP
  2. Please be mindful and considerate of your electricity and water usage during your stay
  3. Electric cars, camping camping cars or motorhomes may not be charged/hooked up to the main electricity supply.

Bed linen and Towels

  1. Bed linen and towels are included in the gîte but should not be removed for use in the garden or around the pool
  2. Bed linen and towels will only be provided for those Guests listed on the booking form and during the rental period
  3. Pool towels are provided on request only
  4. For stays of 10 days or more, bed linen and towels will be changed
  5. The use of sunblock, high factor sun cream and one application sun cream such as P20 can stain white bed linen and towels . Similarly, tanning products, acne cream and makeup can also stain. These yellow stains aren’t visible until after washing. Please be mindful to remove these products before using towels and bed linen
  6. Please discuss bringing your own towels and bedding if staining is unavoidable in your circumstances
  7. Damages to bed linen and towels will be deducted from your security deposit.

Swimming Pool

  1. The swimming pool is available from June 1st to September 30th each year. The pool can be used between 10:30am and 8:oopm each day. If weather conditions allow, the Owners will endeavour to open earlier than June and close it later than September
  2. The pool is regularly maintained but if unusual climatic changes occur, this may affect the chemical balance. If there are any problems with the water clarity, please contact the Owners
  3. Please ensure all guests are familiar with the pool safety notices and the regulations are strictly adhered to. A safety notice and pool rules and regulations are found in the Welcome Pack and are also displayed next to the pool
  4. No glass, bottles or china to be taken or used in the pool area. Plastic glasses are provided. If any glass or china should fall into the pool, the Owners may need to empty , clean and refill the pool. This may take a number of days and may result in the guests losing their deposit
  5. The Owners have the right to close the pool or restrict swimming pool opening times for any period of time under any circumstances in which we believe to be essential for the interests of health and safety
  6. The Owners are not responsible for any loss or inconvenience as a result of unforeseen break down in the pumping/infiltration equipment in the swimming pool
  7. Guests are responsible for ensuring all children in their party are NOT left unattended AT ANY TIME whilst the swimming pool is open
  8. The pool is enclosed by a wall and 2 gates which are operated by a self-closing mechanism. Please ensure that the gates are closed and objects are not used to keep them open
  9. Guests are responsible for ensuring that adults and children respect the safe use of equipment at all times
  10. The Owners will make every reasonable effort to ensure the safety of all Guests, however no liability can be attached to the Owners for unsupervised children or adults being injured as a result of swimming. Guests are responsible for ensuring that users of the pool are adequately supervised at all times
  11. The Owners shall not be liable for any personal injury, loss or damage whatsoever caused as a result of the use of any children’s equipment, toys, balls, BBQ or other equipment left at the property for use of Guests during the rental period
  12. The Lead Guest and the Guest Party and any guest of the same shall use the swimming pool and/or all the facilities provided at the Property including all of its surrounding area entirely at their own risk and the Owners shall not be responsible for any loss, damage, injury or death.

Pets

Pets are currently not accepted. The only exception to this being guide dogs, hearing dogs and other assistance dogs.

Taxe de Séjour

The Owners are obliged to collect Taxe de Séjour on behalf of the local Tourist Office. This payment is 1€ per adult per night and will be added to the balance of the total rental amount, payable 8 weeks prior to arrival.

The Service and its original content, features and functionality are and will remain the exclusive property of Gites de Javarzay.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Gites de Javarzay.

Gites de Javarzay has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Gites de Javarzay shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of France without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
